We do not guarantee that Kimi will be uninterrupted, error-free, secure, or free from harmful components. You use the Services at your own discretion and risk.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death, personal injury caused by negligence, or fraud.
To the maximum extent permitted by law, YooYooLive and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of Kimi.
Where liability cannot be excluded, our total liability for any claim related to the Services shall not exceed the amount you paid to us for Kimi in the twelve (12) months preceding the event giving rise to the claim, or the minimum amount required by applicable law.
You agree to indemnify and hold harmless YooYooLive, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of Kimi, your User Content, or your violation of these Terms or applicable law.
These Terms shall be governed by applicable laws, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Kimi shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to a competent court or arbitration forum as required by applicable law in your jurisdiction.
Nothing in this section limits your mandatory consumer rights under local law.
If you download Kimi from the Apple App Store, you acknowledge that Apple is not a party to these Terms and is not responsible for Kimi or its content. Apple has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligations regarding Kimi.
If you download Kimi from Google Play, you acknowledge that Google is not responsible for Kimi or your compliance with these Terms. Your use is also subject to Google Play's applicable terms and policies.
